Gas Apparatus Warranty StatementFive-year Torch WarrantyBOC Industrial warrants to the purchaser, all BOC torches, torch shanks and cutting attachments, against defects in materials and workmanship (parts and labour) for a period of five years. Five-year Limited Regulator WarrantyBOC Industrial warrants to the purchaser, all BOC gas regulators, against defects in materials and workmanship (parts and labour) for a period of three years. All metallic regulator components are warranted for a period of five years (parts only). The warranty period is established by the manufacturer’s date code which is imprinted on the product, or date of purchase if proof of purchase date is provided by the purchaser with the warranty claim. BOC Industrial makes no other warranty of any kind, express or implied, including without limitation no warranty of merchantability or fitness for purpose. During the warranty period, BOC Industrial agrees, at its option, to repair, replace or refund the purchase price of any product found defective upon inspection by BOC Industrial. This is the sole and exclusive remedy of the purchaser and the sole and exclusive liability of BOC Industrial, whether in contract, in tort, under any warranty, in negligence or otherwise. BOC Industrial shall not be liable under any circumstances for any incidental, consequential, special, indirect or other damages, or for loss of use, revenue or profit, even if BOC Industrial has been advised of the possibility of such damages. The warranty and remedies provided herein shall not apply if a product is modified in any way except by personnel authorised by BOC Industrial, or if anything except genuine BOC replacement parts, nozzles and consumables are used with the equipment. Where the purchaser deals as a consumer (as defined in Section 12 of the Unfair Contract terms Act 1977, that is, does not deal in the course of a business nor hold himself out as doing so and where the goods passing under this agreement to the purchaser are of a type ordinarily supplied for private use or consumption), the above conditions shall not affect the Customer’s statutory right to reject goods. |
